General Terms and Conditions

These Terms and Conditions (the “Terms”) are the terms and conditions on which this Website and Services are made available to you. These Terms were last updated on 28 August 2018. All previous versions of the Terms no longer have effect.

1. INTRODUCTION

1.1 The Terms are a legally binding agreement. By accessing this Website and/or using the Services you agree to be bound by the Terms. Please read the Terms carefully and if you do not agree to any of the provisions of the Terms you should immediately stop using this Website and the Services.

1.2 In addition to these Terms, your use of the Website and/or Services is also subject to the following additional rules (together the “Additional Rules”) which apply to you depending on the type of gambling services you are using:

3. REGULATION

3.1 We are licensed and regulated in Great Britain by the Gambling Commission under the provisions of the Gambling Act 2005 for the purposes of operating and offering internet gambling services (licence number 000-048954-R-327155-001). 4. YOUR IDENTITY

4.1 It is against the law to use the Website or the Services if you are not over eighteen (18) years of age. When you register for an account, you will be requested to provide your name, address, date of birth and contact information. We may ask for further information from you, or use other sources of information, in order to verify that you are over 18 and that the details supplied are correct (this may include, but is not limited to, you providing us with identification and/or us using independent credit reference agencies). If we have not been able to verify your age within seventy two (72) hours of you opening an account and depositing funds, your account will be frozen and no further gambling will be permitted until we verify your age. If we discover that you are younger than eighteen (18), we will close your account and refund you any amounts that you have deposited but not any winnings accrued.

4.2 To use the Website and/or the Services you must also:

•  complete the registration form fully and honestly;

5. YOUR ACCOUNT

5.1 Opening an account

5.1.1 To open an account, click REGISTER. This will direct you to our Customer Registration page where you will need to complete the registration form. Once you have done so, you will be provided with your account details which shall be your reference to your account with us. The information you provide within this registration form MUST be accurate and complete. In the event that we discover that your details are not accurate, we reserve the right to suspend your account and void any winnings. If your account is suspended, you should Contact Us or email support@cbet88.com. After you have completed the registration form, you must click on the “OPEN ACCOUNT” button in order to create your account and use the Website.

5.1.2 You are allowed to choose your own Username/Password combination for your account for accessing the Website. You must keep this information secret and confidential as you are solely responsible for all bets/wagers placed on your account and any other activities taking place on your account. 

5.1.3 We may decline acceptance of a registration request at any time and for any reason.

5.1.4 You can register, hold and operate only one (1) account. In the event that we discover that you operate more than one account, all accounts traced to you shall be suspended and no further wagering can be undertaken until all your accounts and funds have been consolidated into one account. The rest of your accounts will then be closed.

5.1.5 Your account is for your sole personal and recreational use only and shall not be used for any professional or commercial purpose, or by any third party.

5.1.6 You must ensure that you keep your personal details up to date as we may provide notification to you by email, telephone, text message or post. 5.2 Closing an account

5.2.1 If you want to close your account, please Contact Us. Upon request your account will be closed and you will not be able to access your account thereafter. Closure of your account will automatically render any open games, bets/wagers, bonus funds and entries in any promotions void. Provided that you have complied with these Terms, your account balance less any bonuses will be transferred to you by your chosen payment method.

5.2.2 After your account has been closed, it will remain closed unless and until you ask for it to be re-opened. Re-opening a closed account will require you to follow the procedures for opening an account outlined above. However, we may refuse to re-open your account in certain circumstances (including where a permanent exclusion or self-exclusion has been applied to your account pursuant to our Responsible Gaming Policy.

5.3 Dormant accounts

5.3.1 If your account is inactive for a continuous period of twelve (12) months or more it shall be deemed dormant and if the balance on your account is zero it will be closed. If there are any funds left in your account, we will try to reach you by any of the two (2) contact methods that you provided at registration to organise the return of the funds. We will deduct an administration fee from the remaining balance of 5% (£2 minimum) prior to return of funds, and if unable to contact you, a further 5% fee per month will be deducted until the account balance is reduced to zero.

5.3.2 You can reactivate your account at anytime by successfully logging in to your account, making a deposit or placing a bet/wager. You can then request a refund of any administration fees by Contacting Us.

6. YOUR FUNDS

6.1 Depositing

6.1.1 You may deposit funds to your account using any of the payment methods available on the website within the Deposit Page only. We are not responsible for any charges or fees applied by your card issuer, bank or financial institution when you do so. Please check with your card issuer for further information.

6.1.2 You may only bet/wager with the amount of cleared funds held in your account. In order to place bets or wagers you must deposit monies into your account. Further details of how to deposit or withdraw and transfer funds can be found in the Deposit Page or Withdrawals Page of the Website.

6.1.3 You can use any one (1) payment method registered in your name to deposit funds. For payment methods that require a specific account holder, you should only deposit funds into your account from a source where you are the named account holder. If we identify that the named account holder differs from the name registered in your account, we may void any winnings arising from use of such deposits. You may be requested to provide us with documents to verify the details of the payment method(s) used by you to deposit funds.

6.1.4 The minimum amount which you can deposit in your account is £10.00. We may vary the deposit limits for individual members following a review of an individual player’s playing status and account history. We will always inform you before doing so however.

6.1.5 If we incur any charge-backs, reversals, cancellations or other charges in respect of deposits made into your account, we reserve the right to charge you for the relevant amounts incurred.

6.2 Withdrawing

6.2.1 You may withdraw funds from your account using any of the payment methods used to deposit. Withdrawal payments can only be made in the name of and to the registered account holder.

6.2.2 To make a withdrawal request click on Withdraw on the Website. The minimum amount which you can withdraw from your account in a single transaction is £10.00. The maximum amount which you can withdraw from your account in one calendar day is £50,000.00 If, however, for any reason you wish to withdraw your entire account balance, no such limits will apply. 6.2.3 Withdrawals may be subject to other restrictions imposed by the payment solution provider depending on which registered payment method you have chosen. You should ensure that you have read the terms and conditions of your payment solution provider before choosing your deposit/withdrawal option.

6.2.4 You are responsible for providing us with the correct bank account information for the withdrawal of your funds. We will not repay any funds paid to the incorrect account if this was due to your error.

6.2.5 You will not be able to withdraw any funds from your account until we have satisfactorily verified:

•  your identity and that you are eighteen (18) years or older;

•  all deposits made into your account have been confirmed as cleared and none have been charged-back, reversed or otherwise cancelled; and

•  that you have not deposited funds from criminal, illegal or fraudulent activities, in accordance with the anti-money laundering checks set out below.

6.2.6 Further verification checks will be performed when deposits, cumulative wager amount or cumulative withdrawals are in excess of £1,500 in one (1) calendar day. In such circumstances your account may be suspended and we may have to contact you and ask you to provide further information to us in order to complete the Checks. Your Account will remain suspended until you have provided us with such information. If you do not or cannot provide us with such information then we reserve the right to permanently close your Account.

6.2.7 Withdrawals will be processed no later than one (1) calendar day after the identity, age and anti-money laundering verification checks set out above have been completed.

6.3 Placing Bets/Wagers

6.3.1 We reserve the right to decline all, or part, of any bet/wager requested at our sole and absolute discretion. All bets/wagers are placed at your own risk and discretion.

6.3.2 You should make sure that you read the applicable Game Rules carefully before starting to play a game and must comply with the Games Rules when playing a game.

6.3.3 We only accept bets/wagers made online (including via mobile or tablet devices or downloadable applications on a mobile device). Bets/wagers are not accepted in any other form (telephone, post, email, fax, etc.) and where such bets are received, they will be invalid and void regardless of the result.

6.3.4 Funds from your account will be allocated to bets/wagers in the order they are placed and will not be available for any other use. We reserve the right to void and/or reverse any transactions made after a bet/wager has been placed involving allocated funds, either at the time or retrospectively. Bets/wagers will not be valid if there are insufficient funds in your account.

6.3.5 Your use of the sports betting services that we provide is subject to the Sports Betting Rules.

6.3.6 A bet/wager that you request will only be valid once accepted by our servers. Each valid bet/wager will receive a unique transaction code. We shall not be liable for the settlement of any bets/wagers which are not issued with a unique transaction code. 6.3.7 Should a dispute arise, you agree that our transaction log database will be the ultimate authority in such matters.

6.4 Anti-money laundering

6.4.1 It is unlawful for you to deposit funds obtained from criminal, illegal or fraudulent activities into your account (or to attempt to do so). 6.4.2 We monitor unusual or suspicious transactions and we may require that you provide additional identification documentation or proof of your source of funds at any time if we suspect you may be depositing funds obtained from criminal, illegal or fraudulent activities. Until you have satisfactorily passed such verifications, we may freeze your account and retain any funds (including winnings and deposits).

6.4.3 Where we reasonably suspect criminal, illegal or fraudulent activities we may report such activity to the appropriate regulator or authority, close your account and retain all funds in your account (including deposits and winnings).

6.5 No interest or credit

6.5.1 Your Account is not a bank account and is therefore not insured, guaranteed, sponsored or otherwise protected by any banking insurance system. Additionally any money deposited with us in your Account will not earn any interest.

6.5.2 No credit will be offered by us and all bets/wagers must be placed from funds deposited in to your account. We reserve the right to void any bet/wager which may have inadvertently been accepted when the account did not have sufficient funds to cover the bet/wager. Should funds be credited to a your account in error it is your responsibility to inform us without delay and we will recover such funds by an account adjustment.

6.6 Protection of your funds

6.6.1 We are required by our licence with the Gambling Commission to inform customers about what happens to funds which we hold on account for you in the event of insolvency.

6.6.2 We hold customer funds in designated accounts which are separate from the Company’s business funds in bank accounts which we hold with our payment processors. These funds are not protected in the event of insolvency and will form part of the assets of the Company. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: basic segregation.

7. ACCOUNT AND GAMBLING INFORMATION

7.1 Your current balance including any bonus funds is available at all times on the top navigation bar of the Website once you have logged into your account. You may access information about your usage history, Responsible Gaming options and other account details by clicking on My Account on the Website. This will direct you to your Account Profile, Account Statement and Responsible Gaming pages. If you choose to access this information through a third party user inter-face, you may not be able to receive the full information about your history and current balance.

8. YOUR CONDUCT AND PROHIBITED ACTIVITIES

8.1 You agree that in using the Website and/or Services you will not engage in the following prohibited activities (“Prohibited Activities”):

•  Collusion and cheating – cheating at gambling or colluding with others to cheat at gambling;

•  Commercial use - using the Website and/or Services for any commercial purpose or to promote your own or another third party’s products or services;

•  Bonus Abuse – using multiple accounts to claim a bonus or promotion multiple times, or colluding with others to take advantage of bonuses or promotions; or taking any other undue advantage

•  Offensive actions - using the Website for any purpose which is considered to be defamatory, abusive, obscene, racist, sexist, discriminatory, or offensive, including using any abusive or offensive language in your use of the Website and Services (including selecting a username or screen name that is abusive or offensive or by using abusive or offensive language in our chat support function);

•  Viruses - transferring files that contain (but not limited to) viruses, worms, trojans or similar material that may be malicious or harmful;

•  Denial of Service attacks - attacking the Services via a denial-of-service attack or any other form of attack or interference;.or

•  Security breach - attempting to gain unauthorised access to any of the Services, the servers on which the Services are hosted or any server, computer or database connected to the Service, accessing or attempting to access the accounts of other users or to penetrate or attempt to penetrate the Website security measures.

8.2 We may suspend, restrict or terminate your access to this Website, the Services and your account at any time without notice if you commit any Prohibited Activities. We may also void bets and/or wagers and retain any deposits and/or winnings to cover any loses suffered as a result of any such Prohibited Activity.

9. PROMOTIONS AND BONUSES

9.1 All promotions and bonuses are subject to these Terms and any other specific terms relating to the relevant bonus or promotion that we publish on the Website (“Promotion Terms”). In the event of any conflict between the Promotion Terms and these Terms, the Promotion Terms will apply.

9.2 Prior to participating in any promotion or claiming any bonus, you should ensure that you read the Promotion Terms carefully as well as these Terms, as participation in any bonus will be acceptance of the Terms.

10. PAYMENT OF WINNINGS

10.1 You agree that our records (or any records of our third party providers) shall be the final authority in determining any winnings and – subject to your right to bring a claim as set out in the ‘General’ section below - you shall have no right to dispute our decisions in relation to such matters, save in respect of our negligence, breach of these terms or technical failure.

10.2 You are solely responsible for recording, paying and accounting to any relevant authority for any tax or other charge that may be payable on any winnings you receive.

10.3 The maximum aggregate winnings for one account in any one calendar day is £500,000, or any equivalent amount of your chosen currency.

11. PUBLICITY

11.1 From time to time, we may request that you consent to us listing your name on the website for promotional purposes. We will not publish your name without your consent. But if you consent to us doing so, you agree that you will be due no compensation for such publication.

12. RESPONSIBLE GAMING AND FINANCIAL LIMITS

13.ACCOUNT CLOSURE AND TERMINATION

13.1 We may terminate the Terms and close your account immediately upon giving notice via email if:

13.1.2 we reasonably believe that you have committed a material breach of these terms (for the avoidance of doubt, this shall include committing any of the prohibited activities set out in the ‘Your Conduct and Prohibited Activities’ section above);

13.1.3 we reasonably believe that your account is associated in any way with any account that has been terminated for material breach of these Terms or blocked for any reason (including due to suspected fraud, collusion or cheating);

13.1.4 you become bankrupt;

13.1.5 we are requested to do so by the police, any regulatory authority or court; or

13.1.6 your account is deemed to be dormant and its balance is, or reaches zero in accordance with the ‘Dormant Accounts’ section above.

13.2 If we close or suspend your account for any of the above reasons, you will be liable for any arising costs including all claims, losses, liabilities, damages, costs and expenses incurred or suffered by us and you will compensate us for such claims, and we shall also be entitled to withhold and/or retain any and all amounts which would otherwise have been paid or payable to you (including any winnings or bonus payments).

13.3 You may terminate these Terms and close your account and request payment of outstanding funds at any time by Contacting Us. Such termination shall take effect upon the closing of your account, which shall occur no later than forty eight (48) hours after receiving such request. You will remain responsible for any activity on your account between your request and the closing of your account by us. You can also request to close or suspend your account as further detailed in our Responsible Gaming Policy.

13.4 Unless otherwise provided in these Terms and provided that you have complied with these Terms, on closure of your account, any balance in your account (excluding any bonuses) will be returned to you within a reasonable time.

13.5 On termination of these Terms and closure of your account:

•  you shall pay all amounts due and owing to us; and

•  you shall stop using the Website and the Services.

14.COMPLAINTS

14.1 We hope that you are completely satisfied with the Website and our Services. However, if you have a complaint, we will aim to resolve this with you as quickly as possible.

Our Customer Support team will try to handle and resolve all player complaints. If the support team cannot resolve the complaint they will escalate it to management for solution. 14.5 You also have the right to submit your complaint to the European Online Dispute Resolution (ODR) platform that is available http://ec.europa.eu/odr. However, please be aware that this may increase the amount of time it takes to resolve your complaint.

15.DISCONNECTIONS AND INTERRUPTIONS

15.1 Whilst we make reasonable efforts to correct any errors, defects, omissions or malfunctions in the Website and Services as soon as practicable once they have been brought to our attention, we do not promise that the Website and/or Services will be free from errors, defects, omissions or malfunctions.

15.2 We do not promise that the Website or Services will be available uninterrupted and in a fully operating condition. Access to the Website or Services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control.

15.3 The Website and Services are provided on an ‘as is’ and ‘as available’ basis. 15.4 We are not responsible for any losses caused by your poor internet connection, computer malfunctions, power interruptions and other related factors.

16.SECURITY

21.GAME RULES

22.OUR LIABILITY TO YOU

24.7 These Terms and the relationship between you and us shall be governed by, and interpreted in accordance with, the laws of the United Kingdom as follows: if you live in England or Wales the laws of England and Wales will apply and if you live in Scotland, Scottish law will apply. If you wish to take court proceedings against us you must do so within the United Kingdom.

25.INTERRUPTED GAMING POLICY

25.1 In the event of disconnection, when you reconnect to the Website click on the game that you were playing, and you will be prompted to resume your incomplete/unfinished game if there was an outstanding action.

25.2 This excludes any of our live games, which conclude in real time. If any inaction by a player is incurred it will be taken as the players choice and the game will continue and end naturally.

25.3 For games where no additional action is required from you after placing a bet, you can check the outcome of the bet in your Account Statement within My Account. The disconnection will not have affected your game, and you will have the same chance of winning as if no interruption occurred.
